1.- COMPANY ORGANIZING THE RAFFLE 

The company EDP España, S.A. based in: Oviedo, Plaza del Fresno 2, (33007 – ASTURIAS) and C.I.F.: A-33473752 organises, for promotional purposes, a raffle of 40 race numbers for the EDP Rock 'n' Roll Running Series Madrid marathon that will take place on the 26th of September 2021. The race numbers will be distributed this way, according to the social media: 

• INSTAGRAM: 20 Race Numbers for the Marathon.
• FACEBOOK: 20 Race Numbers for the Marathon. 

This promotion has a national scope, will be carried out through Facebook and Instagram and is exclusively aimed for users living in Spain and who are of legal age, in accordance with the provisions of the Requirements for Participation section.

2.- TIME SCOPE

The promotion will begin on July 28th, 2021, at 6 p.m., via Facebook and Instagram, and will end on August 3rd, 2021, at 11:59 p.m. 

Among users who have met all the requirements under these Rules, the Raffle will be held on August 4th, 2021, and the winners will be known that same day. 

3.- REQUIREMENTS FOR PARTICIPATION AND MECHANICS OF THE RAFFLE

Participants should follow the following dynamic:

Follow the indications of the publications enabled for the raffle in each channel:

INSTAGRAM

• Take your picture while you’re training.
• Finish training and log into Instagram.
• Upload your snapshot with the hashtag #EDPPhotoRunner, tag @energia.edp and comment what kind of energy “moves you”.

If the profile is private, the participant must send a screenshot of the image published in the IG profile by direct message to @energia.edp.

Follow the indications of the publications enabled for the raffle in each channel:

FACEBOOK

• Take your picture while you’re training.
• Finish training and log into Facebook.
• Reply to the post enabled on Facebook by uploading your snapshot with the hashtag #EDPPhotoRunner and comment what kind of energy "moves you".

The participation requirements will be as follows:

• Those who reside in Spain and are over 18 years of age can participate through their Facebook and Instagram accounts.
• Only one participation per user and social network will be considered. If the same user comments more than once, only one participation per social network will be considered. The same person cannot be a winner on more than one social network.
• Employees of the EDP Group may not participate or be winners. If the case arises, EDP reserves the right to jump on the list to the winner to be awarded to the next alternate.
• In order to communicate with winners and substitutes, users participating in the Raffle authorize EDP in their different social networks to send them direct messages and public mentions to inform them of their status as winners and request their contact details. In case you are not reachable by Facebook and Instagram and do not provide by private message or email such necessary data within 24 hours after EDP has tried to contact you, the prize will pass to the next substitute or be declared void at the decision of EDP, which will be irrevocable.

Valid participations must meet the above-mentioned requirements.

• EDP will conduct the Sweepstakes by using the platform https://www.easypromosapp.com/es/ among all validly generated comments issued under these Terms and Conditions.

4.- RAFFLE CONDITIONS AND PRIZES

20 winners and 10 alternates per network will be chosen as follows:

INSTAGRAM: 20 Race numbers for the Marathon + 10 substitutes for the marathon.

FACEBOOK: 20 Race numbers for the Marathon + 10 substitutes for the marathon.

The winners will be chosen by using the platform https://www.easypromosapp.com/es/ among all comments generated validly issued under these Terms and Conditions.

EDP may disqualify those who do not meet the requirements, if this is the case, or it is not possible to contact the winner within 24 hours after EDP has attempted to contact him in accordance with these Terms and Conditions, in which case the prize will be passed to the next substitute or declared void, EDP’s decision.

Each prize consists of the delivery of a number code for the EDP Rock 'n' Roll Running Series Madrid marathon, drawing a total of 40 race numbers.

The winners, once confirmed by EDP through a direct message or public mention on Facebook and Instagram, they must provide the necessary data so that they can be sent an email in which we will send them an activation code and instructions. The marathon number code must be exchanged for the winner before 08/08/2021 following the instructions indicated by EDP.

1. EDP reserves the right to publicly disclose the result of the raffle. EDP reserves the right to send private messages and public mentions on Facebook and Instagram and to mention the winner on its website to communicate the result of the Raffle. Participation in this promotion implies authorization of use to EDP of the name and/or image of the eligible participants, if EDP so requires in advertising or journalistic communications regarding the promotion.

2. If, at the time of this promotion, the participating user makes any comment or uses any image, it certifies that it has the rights and/or permissions necessary to publish such participant comment, being the author of the text and/or multimedia material or having the permission of its author, if applicable, and also certifies that he has obtained the permission of any person mentioned or portrayed in the image of the publication.

3. The participating user authorises EDP to share, republish and disseminate its publication and its content on EDP’s own communication platforms (RRSS and web profiles) as well as the images it may contain, without any restriction or consideration.

4. As required by the social networks of Facebook and Instagram (i) will be grounds for automatic disqualification in case of multiple accounts or newly created accounts; (ii) publication of the same comment repeatedly on the same social network.

5. No cash refund of the value of the prize shall be made, nor shall EDP be obliged to exchange it for another.

6. The prize explicitly excludes maintenance, stay, parking, transport and any expenses generated by the use of the prize, which must be borne by the winner.

7. EDP is not responsible for changes in the programming of the EDP Rock 'n' Roll Running Series Madrid, outside of EDP. It is the responsibility of the winner to meet the requirements established by the organization to attend. If these requirements are not met, or if there are setbacks, delays, or similar situations, EDP is not responsible for the non-attendance of the winner to EDP Rock 'n' Roll Running Series Madrid, nor is it responsible for changes or cancellations thereof, foreign to EDP. Under no circumstances will these situations entitle EDP to reimbursement of the prize or to any compensation.

In this sense, EDP declines all responsibility and shall not be obliged to compensate the winners in case of cancellation or changes arising from the health situation or for any other reason, unable to attend the winner due to illness, contagion or quarantine of the winner and/or his close contacts or any other cause, there are transport difficulties or mobility restrictions decreed by the health authorities that prevent the winner from attending the EDP Rock 'n' Roll Running Series Madrid.

8 races. Participation in the raffle implies acceptance of all points of these legal bases. If the winners do not indicate the necessary data to EDP, the prize may pass to the next substitute or be abandoned, and this decision will be irrevocable.

5.- DISQUALIFICATIONS AND PENALIZATIONS

1. If it is proved that any of the participants does not comply with the requirements of the Databases, or the data provided to participate are invalid, their participation will be considered void, and they will be automatically excluded from the raffle losing all rights over the prizes awarded under this raffle.

2. In the event of non-compliance with the rules of conduct contained in the EDP Social Media Legal Notice https://espana.edp.com/es/noticias/2019/04/16/bases-legales-de-las-redes-sociales-de-edp-espana (which include, but are not limited to, the prohibition of insults, spam and rude comments), EDP reserves the right to disqualify winners. Comments or opinions deemed inappropriate, offensive, injurious or discriminatory, or likely to infringe on the rights of third parties shall not be permitted. Comments or multimedia material against an individual that violate the principles of the right to honour, personal and family privacy and self-image shall not be permitted. EDP is not responsible for damages caused by comments made by participants in the raffle, and that at any time could hurt the sensitivity of other participants.

3. Comments that do not fit the object of the Raffle may also be disqualified.

6.- EXEMPTION FROM LIABILITY

EDP is not responsible for any loss, theft, delay or any other circumstance attributable to third parties that may affect the development of this raffle, as well as the participant’s use of the prize obtained from this raffle. EDP does not assume responsibility in cases of force majeure or fortuitous event that could prevent the raffle or the total or partial enjoyment of the prize. 7.- FACEBOOK AND INSTAGRAM

The Raffle is not sponsored, cosigned, administered or associated to Facebook and Instagram in any way whatsoever, so the Participants exclude Facebook and Instagram of all responsibility for any possible damages resulting therefrom.

8.- PERSONAL DATA PROTECTION

In accordance with current regulations on the protection of personal data, users are informed that from the moment they participate in the Raffle, they give their free consent, specific and unambiguous for the processing of your personal data by EDP for participation in this raffle. All data requested by EDP for participation in the Raffle are mandatory. The data subject is also informed that he or she may exercise his or her identity, rights of access, rectification, erasure, opposition, limitation and right to the portability of his or her data, through the e-mail address communications srgpd@edpenergia.es as well as communicating it in writing to EDP, to the following address: Plaza del Fresno, 2, 33007 Oviedo, indicating the reference "EDP Rock 'n' Roll Running Series Madrid race number codes".

Similarly, when the data subject considers that EDP has violated the rights that are recognized by the applicable data protection regulations, he may complain to the Data Protection Officer (dpd@edpenergia.es) or the Spanish Data Protection Agency.

9.- CHANGES. PREVALENCE.

9.1 EDP reserves the right to modify or extend these promotional bases, to the extent that it does not prejudice or impair the rights of the participants in the raffle. EDP reserves the right to suspend or extend the promotion to the extent that it does not prejudice or impair the rights of participants in the promotion. In the same way, EDP may, whenever there is good cause, cancel this promotion before the closing date of the latter, undertaking to communicate in good time the new terms, conditions, or, if applicable, their definitive cancellation.

9.2 In the event of conflict, discrepancy or contradiction between the conditions of these Terms and the provisions of the post/publication of the raffle on the corresponding web and/or social network, the provisions of these Legal Bases shall prevail.

10.- TAXATION OF PRIZES

The prizes of this promotion will be applied the rules in force at the time of acceptance of the prize by the person awarded contained in (i) Law 35/2006 of 28 November on Personal Income Tax, under which, and, where applicable, it will be up to EDP to make the withholding or payment on account of the taxes to which these prizes are subject; (ii) Royal Decree 2069/1999, of 30 December approving the Statute of the State Public Enterprise Lotteries and Betting Entity; (iii) Decree 3059/1966 of 1 December approving the Consolidated Text of Tax Rates; and (iv) other corresponding provisions.

11.- APPLICABLE LEGISLATION AND JURISDICTION

These legal bases shall be governed by Spanish law. The Courts and Tribunals of the city of Oviedo will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfilment of these bases.

12.- ACCEPTANCE OF THESE RULES

Participation in this Promotion implies the express acceptance of all the rules contained in these legal bases. The expression of total or partial non-acceptance or non-conformity with these Rules will imply the exclusion of the participant and as a result, EDP will be released from the performance of any obligation contracted with said participant.
